1. Acceptance of Terms

By downloading, installing, or using the SimpliFLY AI mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and SimpliFLY AI ("we," "us," or "our"). We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

SimpliFLY AI provides an AI-powered search and reference tool for Title 14 of the Code of Federal Regulations (14 CFR), commonly known as FAA regulations. The Service allows users to ask natural language questions and receive answers with citations drawn from 14 CFR.

The Service is intended as a convenience reference tool for educational and informational purposes. It is designed to help pilots, students, instructors, and aviation professionals quickly locate and understand regulatory text.

3. Informational Use Only — Not Legal or Flight Advice

The answers provided by SimpliFLY AI are generated by an artificial intelligence system and are based on regulation text retrieved from the Electronic Code of Federal Regulations (eCFR). You acknowledge and agree that:

• SimpliFLY AI answers are for informational and reference purposes only and do not constitute legal advice, flight instruction, or official FAA guidance.
• AI-generated answers may contain errors, omissions, or outdated information despite our best efforts to maintain current data.
• You are solely responsible for verifying any regulatory information against official sources, including the official eCFR at ecfr.gov and official FAA publications.
• No answer from SimpliFLY AI should be used as the sole basis for any flight decision, regulatory compliance determination, or legal interpretation.
• SimpliFLY AI is not affiliated with the FAA, the U.S. Government Publishing Office, or any government agency.

4. Eligibility and Accounts

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@simplifly.ai if you suspect unauthorized access to your account.

You agree to provide accurate and complete information when creating your account and to keep your account information current.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Attempt to reverse engineer, decompile, or extract the underlying AI models, embeddings, or data systems
• Scrape, crawl, or systematically extract regulation data or AI responses at scale
• Impersonate any person or entity or misrepresent your affiliation
• Transmit any harmful, offensive, or disruptive content
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Use the Service in any way that could damage, disable, or impair its operation

6. Intellectual Property

The SimpliFLY AI name, logo, app design, and proprietary software are owned by SimpliFLY AI and protected by applicable intellectual property laws. You may not use our branding or trademarks without prior written permission.

The FAA regulation text displayed in the app is sourced from the eCFR public API and is in the public domain. SimpliFLY AI does not claim ownership of any regulation text.

AI-generated responses produced by the Service are provided for your personal, non-commercial reference use. You may not republish, sell, or distribute AI-generated responses as a standalone product or service.

7. Subscription and Payments

SimpliFLY AI currently offers a free tier. Paid subscription tiers may be introduced in the future. If and when paid plans are available:

• Subscriptions purchased through the iOS app are processed by Apple and subject to Apple's payment terms.
• Subscriptions purchased through the web are processed by Stripe.
• All subscription fees are stated in U.S. dollars and are non-refundable except as required by applicable law or Apple's refund policies.
• We reserve the right to change subscription pricing with reasonable advance notice.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INFORMATION PROVIDED WILL BE ACCURATE, COMPLETE, OR CURRENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIMPLIFLY AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO ANY FLIGHT DECISIONS MADE IN RELIANCE ON INFORMATION PROVIDED BY THE SERVICE.

9. Indemnification

You agree to indemnify and hold harmless SimpliFLY AI and its affiliates, officers, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice.

You may delete your account at any time through the app's Settings screen. Upon deletion, your data will be permanently removed within 30 days.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.
